Terms of Use

These Terms of Use govern access to and use of the website elchalten.com ("the Site"), created and operated by Los Glaciares Publishers, referred to here as "we" or "the Site". By browsing or using the Site, you accept these Terms of Use in full. If you do not agree, please do not use the Site.

1. Nature of the Site

elchalten.com is an independent digital travel guide to the town of El Chaltén (Santa Cruz Province, Argentina) and its surrounding area, which since July 1, 1999 has offered information about activities, accommodation, dining, transport and other tourism services.

The Site acts exclusively as an informational intermediary: it does not sell tourism services or products, does not process payments or bookings, and is not a party to any contract between the user and the hotels, agencies, transport companies or other providers advertised on the Site (the "providers"). When you fill out a Contact or Booking request form, your message is sent directly to the provider you selected, who is solely responsible for responding, confirming availability, setting prices and delivering the service.

2. Permitted use of the Site

You may use the Site freely to learn about El Chaltén and to contact the providers listed on it. By using the Site, you agree to:

  • Not use the Site for unlawful purposes or in violation of these Terms of Use.
  • Not attempt to access restricted areas, systems or networks connected to the Site without authorization.
  • Not use robots, scrapers, spiders or other automated tools to extract content from the Site without prior written authorization.
  • Not submit false, defamatory, spam, or rights-infringing content through the Contact or Booking request forms.
  • Not overload, damage or interfere with the operation of the Site or the servers that host it.

We reserve the right to restrict or block access to the Site for anyone who violates these Terms of Use.

3. Accuracy of information and liability

We make an effort to keep the Site's information (descriptions, hours, reference prices, availability, activities, weather conditions, etc.) up to date and accurate. However, much of this information is provided or updated by the providers themselves, or may change without notice for reasons beyond our control (weather, season, each provider's own decisions, Los Glaciares National Park regulations, etc.).

Therefore:

  • We do not guarantee that the published information is accurate, complete, or up to date at all times.
  • We recommend you confirm directly with each provider any relevant details before making a decision (prices, availability, cancellation terms, hours, requirements, etc.).
  • We are not responsible for errors, omissions, changes, or lack of response from providers, nor for any inconvenience, loss or damage that may result from a booking, hire or activity carried out with them.
  • We are not responsible for accidents, injuries or issues that occur during tourism activities, treks or excursions booked with third parties, nor for weather or terrain conditions in the area.

Using the Site's information to plan mountain or trekking activities is the sole responsibility of the user, who must assess their own physical ability, the weather conditions and the recommendations of official bodies (Park Rangers, Information Center, etc.).

The Site may contain links to providers' websites, social media, or other third parties. These links are offered solely for your convenience. We do not control and are not responsible for the content, privacy policies or practices of those third-party sites. Accessing them is at your own risk.

5. Intellectual property

The Site contains different types of content, each with its own rights holder:

5.1. The Site's own content

The design, structure, logo, editorial text, GPS tracks and other content created by the Site are the property of Los Glaciares Publishers and are protected under applicable intellectual property law. Unless authorized in writing in advance, reproducing, copying, distributing or commercially using this content outside the Site is not permitted.

5.2. Third-party content used with attribution

The Site's own content sometimes includes third-party photographs used for illustrative purposes (for example, in hero images, carousels or activity illustrations). In all such cases, the image includes the caption "Courtesy of…" identifying its author or rights holder, who retains all rights to that material. Using these images on the Site does not imply any transfer of rights by their authors, nor does it authorize their reproduction by third parties outside the Site.

5.3. Provider listings and microsites

The text, photographs and other content included in each provider's listing and microsite (hotels, agencies, transport companies, etc.) are the exclusive property of that provider, who is solely responsible for holding the necessary rights to that material and for the accuracy of what is published there. The Site does not verify or guarantee ownership of this content.

If you believe any content published on the Site (our own, a provider's, or a third party's) infringes your copyright, write to us at privacidad@elchalten.com specifying the material in question and your claim, and we will review it promptly.

6. Contact and booking request forms

When you fill out the Contact or Booking request forms, your data is handled as described in our Privacy Policy. Keep in mind that this information is forwarded to the provider you selected, who becomes responsible for your inquiry or request from that point on.

Sending these messages depends on our transactional email delivery provider, a third-party service over which we have no direct control. We do not guarantee that sending or receiving the message (either to the provider or your auto-reply email) will be instant, or free from delays, losses, spam filters or other technical failures beyond our control. If you don't receive the auto-reply email within a reasonable time, we recommend contacting the provider directly through other channels (Phone or WhatsApp) or resubmitting your inquiry from the Site.

7. Integrated third-party services and Site availability

We make our best effort to keep the Site available and working properly, but we do not guarantee uninterrupted or error-free access. We may suspend, modify or discontinue the Site (or parts of it) at any time, without notice.

In addition, the Site integrates third-party services to offer certain features, including:

  • Reviews of accommodations and services, provided through a third-party widget.
  • Topographic maps.

These services are operated by third parties unrelated to us. Their availability, accuracy and operation do not depend on the Site, so they may experience interruptions, delays, errors, or become temporarily or permanently unavailable without this being our responsibility.

8. Minors

The Site is aimed at a general audience and does not intentionally collect data from minors through its forms. If you are a minor, we ask that you use the Site together with a responsible adult, especially when contacting providers or arranging a booking.

9. Changes to these Terms of Use

We may update these Terms of Use at any time. Changes will be published on this same page, indicating the last update date. Continued use of the Site after a change constitutes acceptance of the new terms.

10. Governing law and jurisdiction

These Terms of Use are governed by the laws of Argentina. For any dispute arising from their interpretation or application, the parties submit to the jurisdiction of the ordinary courts of Santa Cruz Province, waiving any other venue or jurisdiction that might otherwise apply.
